Titling of assets in the Solo 401k trust
All accounts and assets of the 401k should be titled
- In the name of the 401k and
- Using the EIN of the 401k
This includes bank accounts for the 401k, notes purchased by the 401k, and title to real property owned by the 401k.
Check your plan documents first
The name of the 401k and the EIN of the 401k can be found in your plan documents.
- The 401k trust name and EIN can be found on the EIN document for the 401k, which was included in your set of plan documents
- The 401k trust name may be listed as ABC 401k Plan or ABC 401k Trust. The EIN document for your 401k confirms the correct wording.
- The EIN of the 401k is different from the EIN of your adopting business and is not your personal Social Security Number
Examples of correct titling
If your 401k trust is named DBM 401k Plan and is investing in a note:
- The agreement should list DBM 401k Plan as the buyer
- The title company should list DBM 401k Plan as the lienholder
- Your bank and/or brokerage account(s) be in the name of DBM 401k Plan
- The EIN of DBM 401k Plan should be used, not your Social Security Number
